TOGETHER WITH a 2002 Fleetwood Spring Hill LTD manufactured home, Model #4603C, bearing serial number GAFL234A75064-SL12. PIN: 3794-70-0988. Property Address: 212 Maristone Drive, Statesville, NC 28625. The record owner(s) of the above-described real property as reflected on the records of the County Register of Deeds not more than ten (10) days prior to the posting of this Notice is/are Adam D. Williams. TERMS OF SALE: Any successful bidder will be required to deposit with the Commissioner immediately upon conclusion of the sale a deposit equal to five (5%) percent of the amount of the bid or $750.00, whichever is greater. Any successful bidder shall be required to tender the full balance purchase price so bid at the time the Commissioner tenders to him a deed for the property or attempts to tender such deed, and should said successful bidder fail to pay the full balance purchase price so bid at that time, he shall remain liable on his bid as provided for in NCGS § 1-339.30. All payments to the Commissioner (including any deposit and the purchase price) shall be by certified funds, official bank check, or the equivalent. Cash payments in excess of $500.00 and personal checks will not be accepted by the Commissioner under any circumstance. The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance "AS IS, WHERE IS." The property is being sold subject to all prior liens, unpaid taxes, matters that would be revealed by a current and accurate survey, restrictions, encumbrances, leases, easements, assessments, and other matters of record, if any. Any person wishing to bid for the purchase of the property is advised to have title to the property examined by an attorney of the bidder's choosing. Neither the Commissioner, nor the officers, attorneys, employees, agents, or authorized representatives of either the Commissioner make any warranty relating to the title or any physical, environmental, health, or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition are expressly disclaimed. This sale will be held open ten (10) days for upset bids as required by NCGS § 1-339.25 and is subject to confirmation and other procedures as required by Article 29A of Chapter 1 of the North Carolina General Statutes. If the Commissioner is unable to convey title to this property for any reason, including, but without limitation, the filing of a bankruptcy petition, challenge to the validity of the Commissioner's sale, and/or necessity of resale due to any failure to comply with applicable procedures, the sole remedy of the purchaser is the return of the deposit.
